Terms and Conditions

By booking with China Rae Studios, LLC (“we,” “our,” or “us”), you agree to the following Terms and Conditions. Please read them carefully before securing your session.

1. General Terms
These Terms and Conditions apply to all photography services provided by China Rae Studios. By engaging with our services, you agree to comply with these terms. If you do not agree to these Terms and Conditions, you should not use our services.

2. Booking & Payment

• Contract & Retainer: A signed contract and a non-refundable retainer fee are required to secure your session or event date. The retainer fee is typically 20% of the total session fee.

• Remaining Balance: The remaining balance is due on or before the day of the session, as outlined in your contract. Failure to pay the balance may result in the cancellation of your session.

• Payment Methods: Payments can be made via Visa, Mastercard, American Express, Discover, PayPal, Venmo, Apple Pay, Cash App, Google Pay. All payments are processed securely.

3. Session Timeliness

• Arrival Time: Please arrive on time for your session. Late arrivals may result in a shortened session, and the session will still end at the scheduled time.

• Extended Time: If your session runs over the booked time, additional fees may apply, depending on the availability of time on the schedule.

• No Shows: Failure to attend a scheduled session without prior notice will result in the forfeiture of the retainer fee, and rescheduling will be subject to availability and additional fees.

4. Rescheduling & Cancellations

• Rescheduling: If you need to reschedule your session, we ask for a minimum of 12 hours’ notice. Rescheduling is subject to availability, and a rescheduling fee may apply.

• Cancellations: Retainers are non-refundable but may be applied to a new session if canceled or rescheduled within the allowed timeframe. If a session is canceled after 12 hours of the booked date and time, the retainer fee is forfeited.

• No Show Policy: If you fail to show up for your session without prior notice, the retainer fee will not be refunded, and rescheduling will be considered on a case-by-case basis.

5. Image Delivery

• Final Images: Edited, high-resolution images will be delivered via an online gallery within the timeframe specified in your contract (typically 2–6 weeks).

• RAW Files: RAW, unedited files will not be provided under any circumstances.

• Delayed Delivery: If the delivery of final images is delayed beyond the agreed-upon timeframe, we will notify you with a revised delivery schedule.

6. Copyright & Usage

• Copyright: All images taken by China Rae Studios are protected under copyright law.

• Print Release: Clients receive a print release for personal use only. Commercial use, redistribution, or resale of the images is prohibited without written consent from China Rae Studios.

• Promotional Use: By booking a session, you grant us permission to use your images for promotional purposes, such as on our website, social media, and other marketing materials, unless otherwise specified in writing.

7. Model Release
By booking with us, you agree to allow China Rae Studios to use images from your session for promotional purposes, including website and social media use. If you do not wish for your images to be used in this way, you must notify us in writing prior to the session.

8. Client Responsibilities

• Accurate Information: You are responsible for providing accurate contact information and session preferences. This includes providing any special requests or details about the session.

• Arrival Prepared: Clients should arrive prepared for the session, including clothing, hair, makeup, and any props required. China Rae Studios is not responsible for the outcome of the session if preparations are not made ahead of time.

9. Limitation of Liability

• Injuries and Damages: China Rae Studios is not liable for any injuries, accidents, or damages that may occur during a session. By booking, you agree to release us from any liability related to the session.

• Force Majeure: In the event of unforeseen circumstances, such as natural disasters or personal emergencies, China Rae Studios will make reasonable efforts to reschedule or refund the session, but is not liable for any losses or damages.

10. Weather Policy (for Outdoor Sessions)
For outdoor sessions, we will monitor weather conditions closely. If the weather is unfavorable or unsafe, we will contact you to reschedule. If we are unable to find an alternate date, the session may be credited toward future bookings.

11. Privacy
Your privacy is important to us. Any personal information you provide during the booking process or via our website will be kept secure and will not be shared with any third parties, except as necessary for business operations (e.g., payment processing). 12. Changes to Terms and Conditions
We reserve the right to update or modify these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them regularly. By continuing to use our services after any changes, you agree to the updated Terms and Conditions.
